Terms of Service
Last Updated: May 2, 2026
At a Glance: Summary of Key Points Before you dive into the full legal details below, here is a quick overview of what you are agreeing to when you use TrekCheck:
- Our Service: TrekCheck provides software tools to help you plan trips, coordinate travel groups, share calendars, and track shared expenses. We are a planning platform, not a travel agency or a bank.
- Your Obligations: You must provide accurate account information, keep your login secure, and use our platform respectfully. Do not use our tools for illegal activities, spam, or harassment.
- Payments: If you upgrade to any paid features, subscriptions bill automatically. You can cancel anytime, but we do not offer refunds for partial billing periods.
- Liability: We provide TrekCheck "as is." While we strive for a flawless experience, we are not liable for ruined trips, missed flights, or disputes over shared expenses among your group.
- Disputes: If we have a disagreement, we ask that you reach out to us first. If we cannot resolve it informally, disputes will be handled through binding arbitration rather than in court.
- Termination: You can delete your account at any time. We reserve the right to suspend or terminate accounts that violate these terms.
- Contact: You can always reach us at [email protected].
1. Welcome & Agreement
Welcome to TrekCheck. We are thrilled to help you and your travel companions organize your next great adventure.
These Terms of Service ("Terms") form a binding legal agreement between you and TrekCheck. By accessing our website at https://trekcheck.io, creating an account, or using any of our trip planning tools, you agree to be bound by these Terms. If you do not agree with any part of these Terms, you may not use our services.
We may update these Terms from time to time to reflect changes in our business or legal requirements. The "Last Updated" date at the top of this page indicates when these Terms were most recently revised.
2. About Our Service
TrekCheck provides a collaborative software platform designed specifically for travel and tourism.
What We Do
We offer digital tools that allow users to create travel groups, build shared itineraries, sync calendar times, and track group expenses. Our goal is to eliminate the friction of group travel planning by keeping everyone on the same page.
What We Don't Do
TrekCheck is solely a software provider. We are not a travel agency, booking agent, or financial institution. We do not book flights, reserve hotels, or process peer-to-peer money transfers. Any expense tracking features we provide act simply as a digital ledger to help your group remember who paid for what.
Eligibility and Availability
To use TrekCheck, you must be at least 18 years old or the age of legal majority in your jurisdiction. While we work hard to keep TrekCheck up and running 24/7, we cannot guarantee uninterrupted access. We occasionally need to perform maintenance or push updates, which may result in temporary downtime.
3. Your Account
To unlock the full potential of our collaborative tools, you will need to create an account.
Registration and Accuracy
When you sign up, you must provide accurate, current, and complete information. Using fake email addresses or impersonating others creates confusion for travel groups and violates our rules.
Account Security
You are responsible for maintaining the confidentiality of your password and for all activities that occur under your account. If you suspect someone has gained unauthorized access to your TrekCheck account, you must notify us immediately.
Account Sharing
Because your account is tied to your personal identity within a travel group, you may not share your login credentials with others. Each traveler should create their own free account to join your trip.
Closing Your Account
You have the right to terminate your account at any time through your account settings. Once deleted, you will lose access to all your itineraries, shared calendars, and expense records.
4. Acceptable Use
We want TrekCheck to be a helpful, positive environment for everyone planning a trip. To keep it that way, we have established clear boundaries for how you can use our platform.
You agree that you will not:
- Use TrekCheck for any illegal, fraudulent, or unauthorized purpose.
- Upload or share content that is offensive, abusive, defamatory, or infringes on the rights of others.
- Interfere with or disrupt the security, integrity, or performance of our platform.
- Attempt to scrape, data-mine, or reverse-engineer any part of our software.
- Use our platform to distribute spam, malware, or unsolicited promotional materials to other users.
If we determine that you have violated these rules, we reserve the right to suspend or permanently terminate your account without prior notice.
5. Content & Intellectual Property
Trip planning involves sharing a lot of information, and it is important to understand who owns what.
Your Content
You retain full ownership of all the data, text, photos, and itinerary details you upload to TrekCheck ("User Content"). By posting this content, you grant us a worldwide, royalty-free license to host, display, and distribute your User Content solely for the purpose of operating the platform and sharing it with your designated travel group.
Our Intellectual Property
TrekCheck owns all rights, title, and interest in the platform itself. This includes our software code, design elements, logos, and the unique layout of our calendar and expense tracking tools. You may not copy, modify, or use our intellectual property without our express written consent.
6. Payments & Billing
While we offer core planning features for free, certain premium tools on TrekCheck may require payment.
Pricing and Subscriptions
All pricing for paid features is clearly displayed on our website before you make a purchase. If you sign up for a recurring subscription, your payment method will be charged automatically at the beginning of each billing cycle.
Cancellations and Refunds
You can cancel your premium subscription at any time through your account settings. Cancellation will take effect at the end of your current billing cycle, allowing you to use the paid features until then. We do not offer prorated refunds for partial months or unused time.
Price Changes
We may occasionally adjust our pricing. If we do, we will notify you at least 30 days in advance. Your continued use of the paid features after the price change goes into effect constitutes your agreement to pay the modified amount.
7. Privacy
Your privacy is incredibly important to us, especially when you are sharing travel dates and locations.
We process your personal data in accordance with applicable United States privacy laws, including the California Consumer Privacy Act (CCPA/CPRA) and other state-specific regulations (such as VCDPA, CPA, and CTDPA).
Our data collection is strictly limited to standard business operational data necessary to provide our service, and we only share information with essential third-party service providers (like our hosting and payment processors). For a complete explanation of how we collect, use, and protect your information, please review our full Privacy Policy.
8. Disclaimers & Limitations
We build our tools carefully, but we must be realistic about our legal liabilities.
"As Is" Service
TrekCheck is provided on an "as is" and "as available" basis. We make no warranties, either express or implied, regarding the reliability, accuracy, or fitness for a particular purpose of our platform. We do not guarantee that our service will be error-free or that any specific travel plans will go smoothly.
Limitation of Liability
To the maximum extent permitted by law, TrekCheck and its team shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform. This includes, but is not limited to, financial losses from miscalculated group expenses, missed flights due to calendar syncing errors, or ruined vacations.
In no event shall our total liability to you for all claims exceed the amount you paid to TrekCheck in the twelve (12) months preceding the claim, or fifty US dollars ($50), whichever is greater. Some jurisdictions do not allow the exclusion of certain warranties or limitations of liability, so some of these exclusions may not apply to you.
9. Dispute Resolution
If things go wrong, we want to fix them fairly and efficiently.
Informal Resolution
Before filing any formal legal claim, you agree to try resolving the dispute informally by contacting us at [email protected]. We will do our best to resolve the issue within 30 days.
Binding Arbitration
If we cannot resolve the dispute informally, you and TrekCheck agree to resolve any claims related to these Terms through final and binding arbitration, rather than in court. The arbitration will be conducted in accordance with standard commercial arbitration rules in the United States.
Class Action Waiver
You agree that any dispute resolution proceedings will be conducted only on an individual basis and not in a class, consolidated, or representative action.
Small Claims Exception
Notwithstanding the above, either party may bring an individual action in small claims court if the claim qualifies.
10. Changes & Termination
We need the flexibility to grow and protect our platform.
Modifying These Terms
We may update these Terms at any time. If we make material changes, we will notify you by email or by posting a prominent notice on our website before the changes take effect. Your continued use of TrekCheck after the effective date means you accept the new Terms.
Our Right to Terminate
We reserve the right to suspend or terminate your access to TrekCheck at our sole discretion, without notice, for conduct that we believe violates these Terms or is harmful to other users, us, or third parties.
11. General Legal
These final provisions ensure our agreement functions properly under the law.
- Governing Law: These Terms are governed by the applicable federal and state laws of the United States, without regard to conflict of law principles.
- Severability: If any provision of these Terms is found to be unenforceable or invalid, that specific provision will be limited or eliminated to the minimum extent necessary, and the rest of the Terms will remain in full force and effect.
- Entire Agreement: These Terms, along with our Privacy Policy, constitute the entire agreement between you and TrekCheck regarding your use of the platform, superseding any prior agreements.
- Assignment: You may not assign or transfer your rights under these Terms without our consent. We may freely assign our rights and obligations under these Terms in the event of a merger, acquisition, or sale of assets.
